【AIDS Rights】 20121201 Chang Kun Statement, Wrongfully Accused, Confiscation of Magazine

Statement regarding Chang Kun being wrongfully accused and the seizure of the magazine edited by him “Youth and AIDS”

         I am Chang Kun, in charge of the organization AIBO AIDS Relief, Zheng Zhou CityHe’rbutong Center - based HIV/AIDS prevention and treatment organizationin Henan Province, China. I state responsibly as follows: I will take all legal and humanitarian steps to maintain my dignity and value! I am against any form of misinformation to pretend I have done wrong !

       Since October 25th ,2012, there have been a series of strange things happening in He’rbutong. First, someone wrongly claimed that I am moving to other city. Then, from November 8th to 11th, our office internet was broken for two days without any reasonable explanation. 

       At 15:30 on November 15th , the Domestic security team of the Public Security Bureau of Zhengzhou City, Cultural Market Comprehensive Enforcement Team of Zhengzhou City and the Wenhua Road Branch Office of Zhengzhou Public Bureau came to our office to check up. None of them wore work uniforms and they didn’t show the Work Permit. They seized and held in their custody the Youth and AIDSmagazine with the excuse that the magazines didn’t pass the relevant departments audit and they would to do an appraisal. On the Seizure Sheet, there was no official seal and only one police officer signed her name. I have no idea which Joint Law Enforcement organization the Seizure Sheet belongs to?

       After this series of events happened, I had to cancel a meeting in Hangzhou, andcome back to Zhengzhou City by train overnight on November 17th.

       On November 19th, I met with two department leaders of Zhengzhou City Politics and Law Committee who are responsible for AIDS and ideology. So far we knew that some people set me up by saying that I have some relation to an event—4 young people tore up a picture of the leader Mao Zedong in public at the Zhengzhou Zijingshan Square on October 25th. I only know three of the four people, but I had nothing to do with their actions. I am curious how they thought that I am behind the scenes of this affair, merely because I know the three people ?

       What the most important is that no one has contacted me in any way to check regarding these events until I communicated with the leaders of the Zhengzhou City Politics and Law Committee. And they continue to set me up and harassed my colleagues! They may cheat their leaders and set me up in the name of their duty , I'm so frightened!

       On November 26th , all my colleagues together went to the Domestic security teamof the Public Security Bureau of Zhengzhou City. We met some leaders and clarified some facts. We refused to be framed! However, until now, the Youth and AIDS have not sent back to our office.

       On December 1st, 2012, the Word AIDS Day, There are 7 people with me had taken Hunger Strike for HIV/AIDS action.

       I, Chang Kun, am engaged in the prevention and control of HIV/AIDS since 2004. I am always doing my best and study hard, though there are some rough roads in my life. I found my life fun in the field of AIDS and I aimed to the prevention and control of AIDS for all my life! I gradually achieve my ideal, business, profession and life unification. But now I really can’t understand why someone would set me up!

       In the past eight years , I did my best to serve my country and people, actively undertook the state and national responsibility of the epidemic of AIDS, and got my parents, sister and brother’s support. I worked hard myself in various environments during these years, I coordinated the relationships between various departments, all of this I did solely to solve the problem of HIV/AIDS in China. But today someone told me to end my own life! Am I so afraid of death? I made and kept a will since 2007. The one who said “take your own life” to me, do you have a will? I had a plan to die once, and I was threatened with death from by Email when I criticized one foundation. But this is the first time, that I was told with a word to end my own life. I am very angry!

       I am always honest and public on my work. I will acknowledge anything if I really did it, but on the contrary, no one should be able to set me up if I really didn’t do it!! The 25th World AIDS Day is coming, our country and relevant departments are becoming active to improve AIDS people and their survival/condition. These departments have a series of documents which guarantee the treatment rights ofHIV/AIDS patients and state that no one can refuse and prejudice them. The documents also said that the prevention of AIDS is a complicated work, which requires the whole society’s participation; there is a need to provide the necessary support and help NGOs. Only according to the central requirements about innovation and social management, can we gradually establish and perfect the work mechanism of folk NGOs to participate in HIV/AIDS prevention and control cause!

       What about the current situation? Someone has framed an AIDS activist, which is not only a disservice to our country and government, but also makes trouble for no reason!

       I would like to solve the problem peacefully, but the someone must seek truth from facts ! Sent the Youth and AIDS back to AIBO AIDS Relief, ZhengZhou CityHe’rbutong Center as soon as possible.

【AIDS Rights】 联合国艾滋病规划署世界艾滋病日微博行动:一起努力,实现“零艾滋病就业歧视”

        联合国艾滋病规划署于今日启动世界艾滋病日微博行动,倡导消除对艾滋病感染者的就业歧视。“一起努力,实现零艾滋病就业歧视”的微博行动将一直持续到十二月中旬。通过这一微博行动,联合国艾滋病规划署倡议微博用户发表反对就业方面艾滋病相关歧视的信息,为艾滋病感染者争取平等的就业机会。
 
        艾滋病感染者在不同场所都面临着歧视。歧视是扩大艾滋病预防、治疗和关怀服务的主要障碍,造成越来越多的人可能感染艾滋病。艾滋病感染者在许多情况下经历着各种歧视。
 
        艾滋病感染者常常面临获得医疗救治的困难,无法得到教育和培训的机会,就业机会也常常被拒绝。2011年由国际劳工组织北京局开展的对企业业主的一项调查显示,65%的企业业主认为艾滋病感染者不应该获得平等的就业权利。1000个受访者中将近一半的人认为艾滋病感染者应被剥夺平等的就业机会。这些调查数据表明,大众中对艾滋病感染者的就业歧视是非常普遍的。更令人担忧的是,许多法律和政策中也存在着对艾滋病感染者的歧视,如,《公务员录用体检通用标准》中就拒绝录用艾滋病感染者。
 
        最近几年,尽管在《艾滋病防治条例》中明确规定不得歧视艾滋病感染者,但正是由于这样一些标准而使得许多感染者的就业机会被剥夺。最近,江西省的一位艾滋病感染者小齐申请教师职位,因感染艾滋病而被拒绝录用。小齐已经向当地法院提起诉讼。自2010年以来,已有三位艾滋病感染者申请教师职位而遭遇拒录。向法院提起诉讼的感染者中,他们的诉讼不是被驳回,就是被法庭拒绝受理。这些案例只是冰山一角,许多感染者不希望为了寻求公正而成为大众焦点,或者,许多感染者首先就不会选择去申请这样的职位。
 
        就业方面对艾滋病感染者的歧视造成了谈“艾”色变,使得扩大艾滋病预防和治疗服务面临着极大的困难。解决就业歧视是中国艾滋病防治的重点。法律和政策中对艾滋病感染者的就业歧视,如《公务员录用体检通用标准》中对感染者的歧视,是非常有害的,应将修订这些歧视性的条例作为工作的重点。
 
        联合国艾滋病规划署世界艾滋病日“一起努力,实现零艾滋病就业歧视”的微博行动,旨在通过这一行动,引起大家的注意,并动员微博用户一起努力,倡导消除工作场所的艾滋病相关歧视。参与这一微博行动非常简单,只要在您的微博中发表反对对艾滋病感染者的就业歧视的信息,并使用#零就业歧视#,同时@unaidschina   即可。

The Ministry of Health told local health authorities Friday they must make public their list of hospitals designated for the treatment of HIV/AIDS patients, a move that some HIV/AIDS NGOs doubt will improve access to treatment for those who are in need.

The ministry also told medical institutions to upgrade their equipment and improve staff training and the services they provide.

The ministry's notice came after a man living with HIV/AIDS was refused treatment for lung cancer by a hospital in Tianjin, reported the Beijing Times.

Medical institutions and staff members will be punished according to related laws if they refuse HIV/AIDS patients.

A medical institution that is not on the list of designated hospitals can transfer a patient with HIV/AIDS to a designated hospital or contact local health authorities for help, said the ministry.

If the patients cannot be transferred, local authorities should send medical staffers from the designated hospitals to assist treatment, the notice said.

Although NGOs dedicated to HIV/AIDS prevention and treatment applauded the move, many said it will not radically solve the problem of hospitals refusing to treat infected patients.

The NGOs also complained the ministry's notice was too vague.

"The list of the designated hospital should be scrapped as it can be used as an excuse by some institutions to refuse patients," Chang Kun, director with the Zhengzhou-based HIV/AIDS prevention and treatment organization He'erbutong in Henan Province, told the Global Times Sunday.

"The notice provides no details on improving medical services, nor is there any increased funding," said Beijing Aizhixing Institute in a report released online Saturday.

The institute said the ministry also did not say how medical institutions or staff would be punished if they refused to treat people with HIV/AIDS.

It also noted that there is no reporting system available to receive complaints from patients who are treated badly.

There are currently five regulations in the country concerning HIV/AIDS prevention and treatment, released either by the ministry or the State Council.

 The <wbr>Sixth <wbr>Annual <wbr>��unger <wbr>Strike <wbr>for <wbr>AIDS��n <wbr>World <wbr>AIDS

 

 

World AIDS day has been held December 1st of each year since 2007. There are more than 343 warriors from over 22 countries who will take part in the activities on December 1st. They will not eat any food for 24 hours to support the cause of China’s prevention and control of HIV/AIDS.

 

On December 1st, 2012, world AIDS day, the sixth annual Hunger Strike for AIDS is about to begin. The theme is “expanding AIDS rights, protection of accessibility”. We want more people to pay attention to the importance of legal services to people affected by HIV/AIDS. We hope to eliminate people’s discrimination to people infected with HIV and AIDS patients, and to build the importance of social peace. We also expect to obtain donations to support the AIBO Relief Law Program, especially to open a 400 number phone line. And we hope to obtain donations of legal fees for people living with HIV who suffered injustice.

 

Take the AIBO Relief Law Program as an example. The program provides three hotlines staffed by three professional lawyers. The aim of the Program is to provide professional legal counseling and aid to people affected by HIV, and guide them to safeguard their lawful rights through legal ways. This will promote AIDS anti-discrimination and the justice of society. From December 2010 to June 2012, there have been 119 cases of legal counseling from more than 20 provinces and autonomous regions. Some calls even came from lawyers, seeking counseling on how to obtain evidence when someone affected by HIV was refused by a hospital and regarding the cause of death, regarding which problems should be paid attention to in the lawsuit and so forth.

 

In the first half year of 2011, there were 43 cases legal counseling and 37 cases in the next half year. In the first year of 2012, there were 39 cases. Those numbers break down into the following details; 15 cases were regarding compensation because they were infected by HIV through blood transfusion and the courts have done nothing about them; there were 11 cases called regarding compensation because they are infected by HIV through blood transfusion or blood donation; there were 10 cases for counseling about the privacy tort and privacy blackmail; 10 cases regarding divorce of people infected by HIV and about raising children; 10 cases about employment discrimination and other employment problems; 7 cases about medical discrimination and other medical problems; 8 cases about life assistance6 cases about medical assistance; 2 cases about implementation of the assistance policy; 6 cases where a person thought that another person transmitted HIV to him/her through sex, so the call regarded whether the person shall be investigated for legal responsibility; 3 cases about discrimination in commercial insurance clauses; 7 cases about the forced detection of HIV, or about real-name detection, or regarding the willful withholding of the results after the detection, so the caller inquired about compensation; 2 cases about psychological problems; 7 other cases involving with the people living with HIV; another 22 cases have nothing to do with people living with HIV.

 

In support of ILO (Beijing office), the AIDS Relief Law Project originated on December 10, 2010, on the World Human Rights Day. The AIDS Relief Law Project aims to service the law and human rights work of people with HIV, to promote the implementation of International AIDS and human rights in China and the domestic law of AIDS policy. The main work is to: provide three different hotlines for legal consultation, provide legal aid for typical cases, carry out legal training and seminars about AIDS for judges, lawyers and leaders of communities, to develop law and policy research about AIDS, to advocate for relevant laws and policy involved with AIDS events, and so forth.

This is also a kind of support to us to expand AIDS rights and the protection of access for persons with HIV!
